Terms of Use

These Terms of Use govern your access to and use of velairatech.com and related Velaira-operated product sites, as well as studio services and digital products or subscriptions for which Velaira is the merchant (including payments processed through Paystack).
By using our websites or purchasing services or products from Velaira, you agree to these terms. If you do not agree, do not use the sites or complete a purchase.
Websites or apps Velaira builds for clients, where Velaira is not the merchant, are governed by those clients' own terms. Product-specific terms under Velaira may refine these Terms for that product.
Who we are
Velaira ("Velaira", "we", "us") is a Cape Town based product studio. Contact details are published on our Contact page and in the site footer.
Using our websites
You may browse our marketing and portfolio content for lawful purposes. You must not misuse the sites, attempt unauthorized access, disrupt service, scrape content at scale without permission, or use the sites to send spam or harmful material.
We may update, suspend, or discontinue any part of the sites without notice. Content is provided for general information and does not create a professional engagement until we agree scope in writing.
Quotes, discovery, and studio services
Quote requests and discovery calls are invitations to discuss scope. They do not bind either party to a project until a written agreement or accepted quote is in place.
Studio work is delivered under the scope, fees, and milestones set out in that agreement. Intellectual property for delivered work transfers as described in our engagement terms and About standards: you keep ownership of agreed deliverables once milestones and payment conditions are met.
Digital products and subscriptions
Where Velaira operates a digital product or subscription and charges via Paystack, access is granted subject to these Terms, any product-specific terms, and our Refund & Cancellation Policy.
You are responsible for keeping account credentials secure and for activity under your account. We may suspend access for unpaid fees, abuse, or security risk.
Payments
Payments to Velaira as merchant may be processed by Paystack or other payment providers we designate. Card and bank details are handled by the payment provider under their terms. Refunds and cancellations are governed by our Refund & Cancellation Policy.
Intellectual property
Velaira owns the branding, design, and content of velairatech.com unless otherwise stated. You may not copy or reuse our marks or site materials without written permission, except for fair personal reference linking to our site.
Client project case studies remain subject to any confidentiality or publicity limits agreed with that client.
Disclaimer and limitation of liability
Sites and information are provided "as is" without warranties of uninterrupted or error-free operation. To the fullest extent permitted by South African law, Velaira is not liable for indirect, incidental, or consequential loss arising from use of the sites or from delays outside our reasonable control.
For paid studio work or products, liability is limited as set out in the applicable agreement or product terms, and otherwise to the fees paid to Velaira for the relevant engagement or charge in the twelve (12) months before the claim.
Privacy
How we collect and use personal information is described in our Privacy Policy.
Changes
We may update these Terms from time to time. The effective date at the top of this page will change when we do. Continued use of the sites or Velaira-operated paid services after an update constitutes acceptance of the revised Terms for future use and charges.
Governing law
These Terms are governed by the laws of the Republic of South Africa. Courts of South Africa have non-exclusive jurisdiction, without limiting any non-waivable consumer rights you may have.
